Woolworths Delivery Unlimited Subscription Terms and Conditions
By purchasing the Delivery Unlimited subscription (“Delivery Unlimited Subscription”) you agree to these Terms and Conditions which are to be read in conjunction with the Woolworths Online and Everyday Market from Woolworths Terms and Conditions.
Any capitalised terms that are not defined in the ‘Definitions’ section of these Terms and Conditions, have the meanings given to them in the Woolworths Online and Everyday Market from Woolworths Terms and Conditions.
Conditions of Use
- A Delivery Unlimited Subscription gives you access to the benefits as detailed on our Delivery Unlimited page or otherwise published by us from time to time. A Delivery Unlimited Subscription does not cover any other fees and charges that we may charge from time to time.
- Minimum Spend includes any GST payable on a Woolworths Order or an Everyday Market Order (as applicable) and excludes Delivery Fees, Shipping Fees, Bag Fees and Crate Service Fees, tobacco/smoking products, online donations, gift cards, egift cards, mobile recharge, travel cards and tickets and Pre-order Kiosks and Auto-order products.
- You may only use the Delivery Unlimited Subscription for delivery to a maximum of two (2) delivery locations, and the Business Delivery Unlimited Subscription for delivery to a maximum of four (4) delivery locations.
- The Delivery Unlimited Subscription is for the sole use of the account holder and cannot be transferred to or used for Orders for another customer and cannot be used in conjunction with any other offer in relation to Delivery Fees, Bag Fees or Crate Service Fees unless otherwise stated.
- Delivery is subject to the delivery locations and timeframes that are made available to customers on Woolworths Online from time to time.
- If we determine, acting reasonably, that you have used the Delivery Unlimited Service in an unreasonable or fraudulent manner, we may cancel, revoke or limit your right to enjoy the Delivery Unlimited Service. If you believe that we have unreasonably cancelled, revoked or limited your right to enjoy Delivery Unlimited, you can contact the Customer Care Team via live chat on Woolworths.com.au or on via phone on 1300 969 609.
- New or existing account holders aged 60 and over (excluding business Delivery Unlimited customers) during the Subscription Period are eligible for a seniors specific Subscription Payment for the Delivery Unlimited subscription (Seniors Delivery Unlimited). We reserve the right to terminate an account holder's Seniors Delivery Unlimited subscription at any time if we reasonably believe that the account holder does not meet the eligibility requirements for Seniors Delivery Unlimited set out above.
- You agree that the Delivery Unlimited Subscription is not valid for Remote and Bulk Order deliveries or Pick up or Direct to boot Orders.
- Your Delivery Unlimited Subscription may start with a free trial. This is intended for the account holder to try the Delivery Unlimited service. We reserve the right to withdraw the free trial at any time for any reason. There is a limit of one (1) free trial per account holder.
- The duration of the free trial period will be 30 days starting from the date you sign up for a Delivery Unlimited Subscription. Free trial eligibility is determined by Us at our sole discretion. We reserve the right to revoke the free trial and put your account on hold in the event that we determine you are not eligible.
- We will charge you the Subscription Payment to your Nominated Card at the end of the 30 day free trial period unless you cancel the Delivery Unlimited Subscription before the first Billing Date. To view the end date of your free trial period and details of your Delivery Unlimited Subscription and Subscription Payment, visit ‘My Account’ at Woolworths.com.au.You agree that you are solely responsible for cancelling your Delivery Unlimited Subscription prior to the first Billing Date should you not wish to proceed.
- You may cancel your Delivery Unlimited Subscription via ‘My Account’ at Woolworths.com.au, then selecting “My Delivery Unlimited” and then “Manage Subscription” links. You may also cancel your subscription through our Customer Care Team via live chat on Woolworths.com.au or on via phone on 1300 969 609.
- The Delivery Unlimited Subscription is an ongoing subscription. Your subscription as well as your obligation to pay the Subscription Payments will perpetually auto-renew at the end of the Subscription Period unless you give us notice prior to your next Billing Date that you wish to cancel.
- You can cancel the auto-renewal of your Delivery Unlimited Subscription at any time via ‘My Account’ at Woolworths.com.au, then selecting “My Delivery Unlimited” and then “Manage Subscription” links. You may also cancel your subscription through our Customer Care Team via live chat on Woolworths.com.au or on via phone on 1300 969 609.
- If you notify us that you wish to cancel your Delivery Unlimited Subscription due to a change of mind, the cancellation will take effect from the end of the relevant Subscription Period and you will continue to have the benefit of the subscription for the remainder of the relevant Subscription Period that has been prepaid. In this situation, you will not be refunded for the remainder of the Subscription Period that has been prepaid in which you cancel the Delivery Unlimited Subscription.

- We will not provide refunds where you have changed your mind about your Delivery Unlimited Subscription at any time. This will not affect any rights to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law.
- You must pay the Subscription Payments on each Billing Date during your relevant Subscription Period.
- Amounts charged to your Nominated Card that exceed the funds or credit limit available on the Nominated Card may be rejected and may result in you being charged fees or interest by the issuer of the Nominated Card.

We are not liable for any loss arising from and any costs incurred in connection with:
- us being unable to charge the Subscription Payment to your Nominated Card;
- any unsuccessful payment by you of the Subscription Payment using your Nominated Card (including a chargeback or a failure by you to update your details); or
- you being required to pay the Subscription Payment to us in any other way.
- You authorise us to charge the Subscription Payment to your Nominated Card on each Billing Date. The Subscription Payment and the Billing Date will be disclosed to you at the time that you purchase the Delivery Unlimited Subscription.
- It is your responsibility to ensure that you are able to pay the Subscription Payment on the Billing Date using your Nominated Card and that your Nominated Card details and contact details are up-to-date during the Subscription Period.
- You warrant that you are over 18 years of age and have the capacity and authority to authorise us to charge the Nominated Card.
- If you believe there has been an error in charging your Nominated Card or you wish to notify us about anything relating to these Terms and Conditions, including disputes, please contact our Customer Care Team via live chat on Woolworths.com.au or via phone on 1300 969 609.
- If you select an annual Delivery Unlimited Subscription, you must pay for the subscription annually in advance on the date of purchase and renewal of your subscription.
- If you select a monthly Delivery Unlimited Subscription, you must pay for the subscription on a monthly basis.
- If you fail to pay the Subscription Payment by the Billing Date for any reason (including in relation to a chargeback or failure by you to update your payment details), we will suspend your account for a period of 28 days (“Suspension Period”).
- If payment of the Subscription Payment has not been made by the end of the Suspension Period, we will cancel your account.
- Suspended Account We will send you an email notifying you that your account has been suspended and asking you to update your payment details if you fail to pay the Subscription Payment by the next Billing Date.
- You may update your payment details or retry payment for the Delivery Unlimited Subscription at any time by visiting “My Account” on Woolworths.com.au via the “My Delivery Unlimited” link.
- You will not be able to continue to use your Delivery Unlimited Subscription during the Suspension Period.
- If you make payment of your Subscription Payment during the Subscription Period, your Delivery Unlimited Subscription will be reactivated for the remainder of the Subscription Period and the date of payment will become the new Billing Date.
- Cancelled Account We will attempt to process your Subscription Payment every seven (7) days from the date of payment failure during the Suspension Period.
- If payment of the Subscription Payment is not successfully made before the end of the Suspension Period, we will cancel your Delivery Unlimited Subscription.
- If your Delivery Unlimited Subscription is cancelled, you will not be able to use it and will need to purchase another Delivery Unlimited Subscription for another Subscription Period to continue to use the service.
- There will be no refunds provided if your account is cancelled due to a payment failure.
- We reserve the right to monitor usage of a Delivery Unlimited Subscription and to terminate a Delivery Unlimited Subscription without liability if we believe, acting reasonably, that it is being used in a way that breaches these Terms and Conditions, the Woolworths Online and Everyday Market from Woolworths Terms and Conditions or any applicable law(s).
- We may update these Terms and Conditions at any time, including cancelling the Delivery Unlimited Service. We will give you prior notice if such variation will, in our reasonable opinion, have a material detrimental impact on your and your Delivery Unlimited subscription. If you do not wish to agree to such updates, you may cancel your Deliver Unlimited subscription before the changes come into effect (being the date we notify you of, as determined in our reasonable discretion).
- Without excluding, restricting or modifying your rights and remedies to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law or Woolworths' liabilities under those provisions:
- our liability to you in all other cases will be limited to either:
- the cost paid by you for your Delivery Unlimited Subscription; or
- in the event the Delivery Unlimited Service is terminated for all subscribers, a pro-rated refund of your Subscription Payment amount that remains unused at the date of termination;
- we will not be liable to you for indirect and consequential loss arising from or connected to these Delivery Unlimited T&Cs in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct; and
- our liability to you for loss or damage of any kind arising out of or in connection with these Delivery Unlimited T&Cs or the Delivery Unlimited Service is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
- our liability to you in all other cases will be limited to either:
- In these terms:
- one (1) month from the date on which you purchased your Delivery Unlimited Subscription and each successive one (1) month period in which the subscription is renewed for monthly subscriptions; and
- one (1) year from the date that you purchased your Delivery Unlimited Subscription and each successive year in which the subscription is renewed for annual subscriptions.

Definitions
“Billing Date” means: (i) for monthly subscriptions, the day you purchase the Delivery Unlimited Subscription and the date that is every month after that date during the Subscription Period, as notified at the time you purchase the Delivery Unlimited Subscription; or (ii) for annual subscriptions, the day you purchase the Delivery Unlimited subscription only. For free trials, the first Billing Date is 30 days after you sign-up for the Delivery Unlimited Subscription.
“Everyday Market from Woolworths” means the online platform known as “Everyday Market from Woolworths” that is part of woolworths.com.au or the Woolworths Online mobile application, where you may purchase products sold by our Everyday Market from Woolworths partners.
“Everyday Market Order” means the total of all products sold by Everyday Market partners that are described as “Everyday Market items” at online checkout and are purchased by you in the one payment transaction via Everyday Market from Woolworths. For the avoidance of doubt, an Everyday Market Order does not include any products that are described as “Woolworths items” at checkout.
“Minimum Spend” means the minimum amount you are required to spend after all discounts, coupons and exclusions are applied to enjoy Delivery Unlimited benefits, as advertised on the Site from time to time.
“Nominated Card” means the debit or credit card you have nominated in connection with your Delivery Unlimited subscription online, or by subsequent notification to us and which, under these terms (“Agreement”), we are authorised to charge the Subscription Payment.
“Subscription Payment” means the Subscription Payment amount for your Delivery Unlimited Subscription that is applicable to your plan and disclosed to you at the time of purchase or as updated by us with prior notice to you from time to time.
“Subscription Period” means:
“Terms and Conditions” means these Woolworths Delivery Unlimited Subscription Terms and Conditions.
“We”, “us” and “our” means Woolworths Group Limited (ABN 80 000 014 675).
“Woolworths Online” means www.woolworths.com.au and includes its mobile application.
“Woolworths Order” means the total of all products sold by Woolworths Group Limited that are described as “Woolworths items” at online checkout and are purchased by you in the one payment transaction via Woolworths Online. For the avoidance of doubt, a Woolworths Order does not include any products that are described as “Everyday Market items” at checkout.
