Woolworths Scan&Go Service
Terms and ConditionsThese terms and conditions ( “Terms”) apply to your use of the self-scanning and checkout functionality provided by Woolworths Group Limited (ABN 88 000 014 675) (“Woolworths”, “we”, “us” and “our”) through the Woolworths Scan&Go application (“Scan&Go App”) or Scan&Go Trolley (collectively the “Scan&Go Service”). By accessing and using the Scan&Go Service, including purchasing goods and services through the Scan&Go Service, you agree that you will be subject to and comply with these Terms. If you do not agree to these Terms, you must not access or use the Scan&Go Service.

Availability

Stores
- The Scan&Go Service is only available in selected Woolworths stores as notified by Woolworths from time to time.

Eligibility
- The Scan&Go Service is only available to registered Everyday Rewards members who are Australian residents aged 18 and above.
- Woolworths reserves the right, in its sole discretion, to invite such registered Everyday Rewards members, as it sees fit, to use the Scan&Go Service

Scan&Go App requirements
- In addition to meeting the eligibility criteria in clause 1.2(a), to access the Scan&Go
App, you must:
- have a valid payment method as specified in the Scan&Go App;
- have a current generation mobile device operating on the Android or iOS operating systems. The latest mobile operating system is recommended for best use. You may be required to upgrade the operating system on your mobile device to continue using the Scan&Go Service if we update the version(s) that the Scan&Go App supports.
- In addition to meeting the eligibility criteria in clause 1.2(a), to access the Scan&Go
App, you must:

Accessing Scan&Go
- You agree that use of the Scan&Go Service is entirely voluntary, at your own risk, personal to you and is non-transferrable. You may elect, at any time, to cease using the Scan&Go Service and process your shopping in the usual manner at a standard checkout in store.
- You agree that you will not loan, hire or otherwise allow any third party to use the Scan&Go Service using your registration details or smartphone.
- If you change your smartphone, you may need to download the Scan&Go App and login again.
- Subject to clause 1.4(b), you may use the Scan&Go App on multiple devices but you can be logged in the Scan&Go App on one device only at any time.

Use of the Scan&Go Service in-store

Availability and access
- Subject to clause 2.1(c), the Scan&Go Service is only available during the trading hours of the nominated Woolworths store(s) participating in the Scan&Go Service.
- You must ensure you are logged in to the Scan&Go App before being able to use the Scan&Go App in-store.
- The Scan&Go Service is provided on an ‘as is’ basis and we do not guarantee that access to the Scan&Go App and/or the Scan&Go Service will be available at all times during trading hours. Your access to the Scan&Go App and/or the Scan&Go Service may be temporarily restricted for repairs, maintenance or the introduction of new features or functionality

Functionality and security
- While we take reasonable steps to make the Scan&Go Service convenient and enjoyable, you accept that we cannot guarantee that the Scan&Go App and/or the Scan&Go Service will be fault free or that it will meet your requirements.
- We take reasonable steps to secure the Scan&Go Service and act in accordance with Privacy laws. However, you accept that we cannot guarantee the security of the Scan&Go App and/or the Scan&Go Service against unlawful access or use.

Internet access
- Internet access is required for use of the Scan&Go App on your own device.
- You can choose to connect to the Woolworths in-store wireless internet service (if available) at no cost to you. The in-store WiFi connection will appear as ‘WoolworthsGuest WiFi’ in your list of available networks. Access to the Woolworths in-store wireless internet service is subject to separate terms and conditions that you will need to accept prior to accessing or using the Woolworths in-store wireless internet service.
- If you do not connect to the in-store wireless internet service, you can choose to, or your smartphone may, use your own data service with your mobile service provider instead of the Woolworths WiFi service.
- If you choose to, or your phone uses your own data service with your mobile service provider, your service provider may charge you for data usage and you are responsible for any internet access charges and data usage charged by your service provider.

Check in and Checkout process
- You must follow the appropriate steps to “check in” and “checkout” each time you use the Scan&Go Service.
- If you do not follow the appropriate processes, we reserve the right to suspend, disable or terminate your ability to use the Scan&Go Service.

Minimum and maximum spend
- There is no minimum spend for using the Scan&Go Service.
- Subject to clause 2.6, you can purchase items up to the total amount notified by us to you from time to time (“Maximum Amount”) using the Scan&Go Service in any one transaction. If your total cart amount exceeds the Maximum Amount, you will need to pay for your items at a checkout register of the store.

Excluded purchases
- You cannot purchase the following items using the Scan&Go App, Scan&Go Trolleys and
the
Scan&Go Service and you will need to pay for these items at a checkout register of the
store:
- Alcohol/Liquor;
- Tobacco;
- Other restricted products that are subject to certain restrictions (for example, age restrictions) on their sale by relevant law such as sharp objects such as knives, blades, saws or any related sharp objects;
- Gift Cards;
- SIM cards;
- purchases from concessions, PreOrder kiosks and the coffee shop;
- Manual price products;
- Recalled items;
- any other products as nominated by us from time to time, (together, “Excluded Purchases”).
- You cannot purchase the following items using the Scan&Go App, Scan&Go Trolleys and
the
Scan&Go Service and you will need to pay for these items at a checkout register of the
store:

Scan&Go Service in-store for scanning and paying for products
Scan checks are an ordinary part of the Scan&Go serviceScan checks trigger for various reasons, like shopping behaviourScan checks help us prevent stock loss and review our technology- The Scan&Go Service is designed to provide you with:
- the functionality to scan the barcode or other code we nominate (each, a “Code”) for each product in the store (other than Excluded Purchases as set out in clause 2.6 above) that you wish to purchase; and
- if you are:
- Using the Scan&Go App - the ability to use the list of Codes that were scanned into the Scan&Go App to enable you to pay for those products through the Scan&Go App using your linked payment card.
- Using the Scan&Go Trolley- the ability to pay for those products at the designated Scan&Go in-store checkout, or on the Scan&Go Trolley (if applicable).
- Any deductions for advertised promotions or coupons will be applied at the checkout before payment. In the event that there is a discrepancy between the price shown in-store and the price shown on the Scan&Go checkout, please see a team member at our service desk for assistance.
- Scan&Go Trolley will display the final price you will pay as well as any savings. At times, we may display the final price together with savings across groups of products when a discount applies across multiple items and/or multiple discounts apply to the same item(s). This means that the display of what you will pay and save may be slightly different to how we display it on the shelf ticket.
- Once a transaction has been completed, your e-receipt will be available in the Everyday Rewards app or Woolworths app.
- In addition to our in store bag check policy, you agree that we may, at any time (including,
pursuant to clause 2.4(b) of these Terms):
- check items in your bag or trolley and compare the items to your Scan&Go cart; and/or
- rescan all the items in your bag or trolley.
If there is a difference between your own scan and our scan, then we may reclaim the items in your Scan&Go cart (“Bagged Item(s)”) that you have not paid for or charge you for those Bagged Item(s).
If you scan items incorrectly on multiple occasions, in addition to any of our other rights including under these Terms, we may suspend, disable or terminate your ability to use the Scan&Go App and the Scan&Go Service.
- You acknowledge and warrant that:
- you are responsible for ensuring that the Code is correctly scanned by you;
- for products that are sold by weight, you are responsible for ensuring that the products are weighed correctly by you;
- you must pay for, and have paid for, all Bagged Items prior to leaving the store; and
- you have and will comply with all relevant laws including relevant laws relating to your use of the Scan&Go App, Scan&Go Trolleys and/or Scan&Go Service.
- We may conduct checks (including checking of your bags and comparing the items in your bag to your receipt and rescanning all the items in your bag) or take other steps to verify each of the matters referred to in sub-clauses (e)(i) — (iv).
- Scan&Go Trolleys are Woolworths property and must remain inside Woolworths supermarket at all times. After completing your shop, you must return the Scan&Go Trolley to the designated location in-store.

Payment

If you are using the Scan&Go App:
- The Scan&Go App details payment methods that are accepted for payment of items using the Scan&Go App (“Accepted Payment Method”).
- You must save your nominated Accepted Payment Method details in the Scan&Go App to access and use the Scan&Go Service in the Scan&Go App.
- Payment for transactions using the Scan&Go Service is made from the nominated Accepted Payment Method saved in the Scan&Go App and you authorise us to deduct the total amount that is payable for your Scan&Go transaction from your Accepted Payment Method details.
- If we are unable to successfully process your payment using your nominated Accepted Payment Method, your financial institution or service provider may charge you for the dishonoured payment. You are responsible for any fees and charges charged by your financial institution or service provider including, without limitation, any dishonour fees.
- In the event that your nominated Accepted Payment Method is a valid credit card, at the time that the credit card is added to the Scan&Go App, we will collect a $0.01 pre authorisation from your credit card which will stay on hold for a period of up to 30 days.

If you are using a Scan&Go Trolley:
- You must follow the instructions for payment on the Scan&Go Trolley.

In general:
- We may perform fraud and risk assessments on your Accepted Payment Method at any time. We have processes in place to assist in detecting transactions that may be illegal or in breach of these Terms.
- Subject to clause 2.7(b), you will be charged the price for a product that is displayed on the shelf tickets.
- If we are unable to successfully process your payment for your Scan&Go transaction, then you will be asked to transfer your transaction to a register to complete payment.
- You must not pay, or attempt to pay, for any goods or services through any fraudulent or unlawful means.

Everyday Rewards
Earning and redemption of EverydayRewards points will remain as normal as per terms and conditions located at www.woolworthsrewards.com.au and is the same for transactions using the Scan&Go Service as it is for in-store transactions without using the Scan&Go Service.

Returns
- The Woolworths Returns Policy applies to all purchases of goods and services using the Scan&Go Service and forms part of these Terms.

Intellectual Property

Your acknowledgements and responsibilities:
- You
- acknowledge that the copyright in the Scan&Go App and the Scan&Go Service, the software, design, text and graphics comprised in the Scan&Go App, the selection and layout of the Scan&Go App and the Scan&Go Service and the content and materials on the Scan&Go App and the Scan&Go Service (together, the “Materials”) are owned by or licensed to us;
- must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public a Material without our prior written consent; and
- subject to sub-clause (b), must not frame or embed in another website, screen, page, app, phone or any material whatsoever any of the material appearing on the Scan&Go App and/or the Scan&Go Service (including, without limitation, the Materials) without our prior written consent.
- You may:
- store a reproduction of the content on the Scan&Go App on your smartphone for the sole purpose of viewing the content and Materials; and
- print hard copies of the content and Materials for the sole purpose of viewing and purchasing goods and services but not for any other use, including commercial use.

Trademarks
The Scan&Go App and the Scan&Go Service contains registered trademarks and other trademarks which are protected by law. You must not use any of the marks or trademarks appearing on the Scan&Go App or the Scan&Go Service or our name or the names of our related bodies corporate without our prior written consent. You must not use any of the other company, product and services marks on the Scan&Go App or the Scan&Go Service that are owned by other third parties (including our suppliers) without obtaining the relevant third party owner's consent.

General restrictions

You must not:
- use the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service for any activities that breach any laws, infringe a third party's rights or are contrary to any relevant standards or codes;
- use the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service in a manner or way, which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Scan&Go App and/or the Scan&Go Service;
- make fraudulent or speculative enquiries, purchases or requests through the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- use another person's details without their permission or impersonate another person when using the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- post or transmit any obscene, indecent, inflammatory or pornographic material or any other material that may give rise to civil or criminal proceedings;
- tamper with or hinder the operation of the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- intentionally or recklessly damage or in any way impact the functionality of a Scan&Go Trolley;
- knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- modify, adapt, translate or reverse engineer any portion of the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- remove any copyright, trademark or other proprietary rights notices contained in or on the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- reformat or frame any portion of the screen or pages that are part of the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service;
- create or use accounts by automated means or under false or fraudulent pretences;
- use the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service to violate the security of any computer or other network or engage in illegal conduct;
- take any action that imposes or that would, in our reasonable opinion, result in an unreasonable or disproportionately large load on our infrastructure;
- use the Scan&Go App, Scan&Go Trolley and/or the Scan&Go Service other than in accordance with these terms and conditions; or
- attempt any of the above acts or engage or permit another person to do any of the above acts.

You must use the Scan&Go App, Scan&Go Trolley and Scan&Go Service as intended, and in accordance with Woolworths’ reasonable directions.

Termination
By us
- We may terminate, suspend, discontinue or change the Scan&Go App, Scan&Go Trolley or the Scan&Go Service at any time without prior notice to you. We do not represent or warrant that the Scan&Go App or the Scan&Go Service will continue to be maintained by us or have any particular functionality or features.
- We may terminate any Scan&Go Service at any time, in whole or in part, for any reason whatsoever, without prior notice or extend the Scan&Go Service to additional stores at any time.
- Without limiting any of our other rights and remedies at law, we may suspend, disable, terminate or
limit your access to, and use of, the Scan&Go App, Scan&Go Trolley and/or the Scan&Go
Service at any
time and at our sole discretion without notice. Grounds for doing so include (but are not limited
to):
- any abuse or attempted abuse or any inappropriate use of the Scan&Go App, Scan&Go Trolley, Scan&Go Service or anything associated with Woolworths;
- an act or omission contrary to these Terms
- any use or attempted use of the Scan&Go App, Scan&Go Trolley and/or Scan&Go Service in a manner contrary to these Terms;
- any reasonable suspicion of unacceptable conduct in connection with the Scan&Go App, Scan&Go Trolley and/or Scan&Go Service, including any reasonable suspicion of dishonesty, fraud, theft, wrongful conduct or tampering of the Scan&Go App, Scan&Go Trolley and/or Scan&Go Service; or
- any other grounds specified in these Terms.
- Your participation, access to and use of the Scan&Go App, Scan&Go Trolley and Scan&Go Service will immediately terminate if your Everyday Rewards membership and/or Woolworths Online account is terminated for any reason whatsoever.
By you
You may stop using the Scan & Go Service at any time and for any reason.

Woolworths' Liability
- Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us to you fail to meet a consumer guarantee under the Australian Consumer Law.
- Without excluding, restricting or modifying the rights and remedies to which you may be entitled
under these consumer guarantees provisions of the Australian Consumer Law or Woolworths' liabilities
under those provisions and to the maximum extent permitted by law:
- you acknowledge that the Scan&Go App, Scan&Go Trolleys and the Scan&Go Service (including any accessories supplied by us for use) is provided on an "as is'' basis and we do not guarantee that the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service (including any accessories supplied by us for use) will be fault free or that it will meet your requirements. We do not make any warranty or representation as to the suitability of the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service (including any smartphone holders supplied by us for use) for any purpose;
- we exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service (including any accessories supplied by us for use) or the subject matter of these Terms; and
- we will not be liable to you in any way for any cause in connection with the following
matters:
- You are unable to use the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service for any reason;
- Your mobile device, hardware or software is corrupted, damaged or fails to operate for any reason or is lost or stolen;
- The Scan&Go App, Scan&Go Trolleys and/or Scan&Go Service (including any accessories supplied by us for use) fails to work as intended and we do not correct any error or defect including any compatibility issues of the Scan&Go App or Scan&Go Trolleys with your equipment or software;
- Any interruptions or delay in the operation of, or any reduction or failure in the provision of the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service;
- Any acts, errors or omissions by us in the course of providing the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service (including as referred to in these Terms);
- Any modification, suspension, termination and/or discontinuance of the Scan&Go App, Scan&Go Trolleys and/or the Scan&Go Service.
- without limiting clause 9 (b)(iii), any liability we may have to you in negligence, breach of contract or otherwise, and all conditions and warranties as to the condition, suitability, quality, fitness or safety of any goods or services supplied by Woolworths pursuant to these Terms, whether express or implied by statute, are excluded to the maximum extent permitted by law, and, where liability cannot be excluded, our liability to you will in all cases be limited to to the purchase price of the good or services you purchase using the Scan&Go Service.
- without limiting clause 9(b)(iii) and 9(b)(iv), we will not be liable to you for indirect and consequential loss arising from or connected to this agreement in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, business interruption, loss or corruption of data and any other commercial or economic loss of any kind).

Governing Law
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.

Changes to these terms and conditions
- We may change these terms and conditions at any time. We will provide you with prior notice of changes, if in our reasonable opinion, a change will have a material detrimental impact on you. If you do not agree to these terms and conditions, you can stop using the Scan&Go Service.
- We recommend that you read these terms carefully each time you use the Scan&Go Service.
