2018 Back To School Promotion Terms & Conditions

Information on how to enter and rewards form part of these Terms & Conditions. By participating, claimants agree to be bound by these Terms & Conditions. Claims must comply with these Terms & Conditions to be valid.

Details Eligible Claimants

The Promotion is open to residents of Australia aged 13 years or over. Individuals between the ages of 13 and 17 years (inclusive) must obtain parental/guardian consent to enter. Parents/guardians may be required to enter into a further agreement with the Promoter as evidence of consent to the minor participating this Promotion.

Employees of the Promoter (and their immediate families), its associated companies, and any other agencies associated with this Promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, brother, sister, step-brother or step-sister.

How to Claim

To claim, individuals must undertake the following steps:

(a) purchase at least three (3) participating products (any product identified in the ‘Participating Products Schedule’, available at the end of these Terms & Conditions and at woolworths.com.au/BTS) (“Participating Products”), in a single transaction, from any Woolworths supermarket store across Australia (including Metro and small format supermarket stores but excluding Woolworths Petrol convenience stores) or at Woolworths Online (www.woolworthsonline.com.au), (subject always to availability of Participating Products) during the Purchase Period (“Qualifying Transaction”);

(b) retain the original Woolworths store receipt issued at the point of sale of the Qualifying Transaction (for in-store transactions) or a copy of the online order number of the Qualifying Transaction (for Woolworths Online transactions); and

(c) visit woolworths.com.au/BTS, follow the link to the online claim form, input the requested details, including but not limited to the full receipt number or online order number (whichever is relevant), first name, last name, valid email address and full street address and submit the fully completed claim form during the Claim Period.

Limits on claims

Multiple claims are permitted, subject to paragraph 6 of the ‘Further Details’ section below, and the following: (a) only one (1) claim permitted per Qualifying Transaction (regardless of the number of Participating Products purchased in total within the transaction); (b) a maximum of one (1) claim will be accepted per household per day; (c) each claim must be submitted separately and in accordance with these Terms & Conditions; and (d) unrecognised Woolworths receipt numbers or Woolworths Online order numbers will be deemed invalid in the absolute discretion of the Promoter.

The Promotion is strictly limited to the Total Reward Cap.

Purchase Period

Eligible purchases must be made between 12.01am AEDST on 10.01.18 and 11.59pm AEDST on 06.02.18 (“Purchase Period”).

Claim Period

Claims may be submitted between 12.01am AEDST on 10.01.18 and 11.59pm AEDST on 20.02.18, or once 176,000 valid claims have been received, whichever is first to occur (“Claim Period”).

Reward Details

The first 176,000 valid claims received during the Claim Period will each be awarded with a pack of personalised vinyl stick-on labels (4 to 16 labels per pack, depending on label shape chosen) valued at $12.50 a pack (each a “Reward”).

There are a maximum of 176,000 rewards available in this Promotion (“Total Reward Cap”).

Maximum total Reward pool is up to the value of $2,200,000.

Reward Delivery

Rewards will be delivered to the successful claimants’ address (as submitted on the online claim form) within 28 days after the successful claim is submitted. Rewards will be delivered in Australia only.

Notification of Successful Claimants

Successful claimants will be notified on-screen at the time of claim submission and in writing by email. All claims are subject to any verification procedures by the Promoter.

FURTHER DETAILS

1. Rewards are not transferable, exchangeable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into. In particular, Rewards may not, without the prior consent of the Promoter and any applicable third party supplier of the Rewards (“Supplier”), be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a Reward is sold or used in breach of this condition, the Promoter or the Supplier may, at their absolute discretion, withdraw the Reward. Where a Reward has been withdrawn in accordance with this clause, no refund, substitute or compensation will be offered.

2. Claims are deemed to be received at the time they are received by the Promoter and not at the time of the submission by the claimant. The Promoter accepts no responsibility for late, lost or misdirected claims or other communications. The Promoter assumes no responsibility for any failure to receive a claim or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches, theft or destruction, any cause beyond the Promoter’s control, or unauthorised access to or alteration of the promotion. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. Further, the Promoter at its sole discretion may recommence this promotion under the same conditions.

3. If any Reward becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Reward of equal or greater value, subject to any written directions from the various authorities.

4. If a claimant’s contact details change at any time, that claimant must notify the Promoter of their correct contact details immediately.

5. Claimants can only enter in their own name. Claimants who enter using multiple aliases may be disqualified. The Promoter reserves the right to request verification of age, identity, residential address of claimants and any other information from claimants relevant to a claim or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, is in breach of these Terms & Conditions, provides claims that are offensive or otherwise inappropriate in the sole opinion of the Promoter, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this promotion (including the use of automatic, repetitive, robotic, programmed or similar claim methods or agents, or the use of a competition entry service), or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

6. If consumers are required to purchase a product to enter, then it is a condition of the prize or reward being awarded that the claimant retain a clear copy of their original receipt and provide it to the Promoter as proof of a valid purchase to enter this promotion.

7. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used. Any contact details incorrectly entered on the website may invalidate the relevant claim, in the Promoter’s discretion.

8. The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a prize or reward or in relation to the promotion, except for any liability which cannot be excluded by law.

9. Any prize or reward supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any claimant as a result of the conduct of any third party supplier or otherwise as a result of the claimant accepting and/or using a prize or reward (even if caused by negligence), except for any liability which cannot be excluded by law. Nothing in these Terms & Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

10. If in the conduct of this Promotion, the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 (Cth) or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit, prize or reward won.

11. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize or reward.

12. Before a prize or reward is awarded, the claimant and any other person(s) sharing the prize or reward with the claimant may be required to sign an agreement to release the Promoter from any liability arising from the use of the prize or reward.

13. Claimants consent to the Promoter using their name, image and/or voice in the event that they are a claimant in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

14. Claims remain the property of the Promoter. The personal information of claimants, will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties, the Promoter’s related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) for the purpose of processing and conducting the promotion) and for promotional purposes, public statements and advertisements surrounding this promotion. By entering this promotion claimants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the claimant. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy can be viewed on www.woolworths.com.au. 15. These Terms & Conditions are governed by the laws of NSW, and where applicable, each of the relevant States/Territories of Australia.
